Golden Maid Terms of Service

Welcome to the Terms of Service (these “Terms”, this “Agreement”) for Golden Maid Services LLC (the “Company”) and any products, services, content, tools, features and functionality (together with the Website, the “Services”) offered by Golden Maid Services LLC together with its parents, subsidiaries, affiliates, agents, representatives, consultants, employees, officers, and directors (collectively, “Golden Maid”, “Company”, “Employee”, “we”, or “us”).

For purposes of these Terms, “client”, “you” and “your” means you as the user of the Services. If you use the Services on behalf of a company or other entity, then “you” includes you and that entity, and you represent and warrant that (i) you are an authorized representative of the entity with the authority to legally bind the entity to these Terms, and (ii) you agree to these Terms on the entity’s behalf.

Please read these Terms carefully, as they include important information about your legal rights. By accessing and/or using the Services, you hereby acknowledge that you have reviewed and are agreeing to these Terms. If you do not understand or agree to these Terms, you are not permitted to use the Services.

Changes to the Terms of Use

Golden Maid reserves the right to revise and update this Agreement and any other policies at any time in our sole discretion. All such changes are effective immediately when they are posted or provided within the Services. Your continued use of the Services after any such changes are posted or otherwise provided means that you accept and agree to the changes, and you are expected to review this Agreement and other policies frequently. If Golden Maid makes a material change, Golden Maid may notify you here, by email, by means of a notice on our home page, or by other means Golden Maid deems appropriate. What constitutes a “material change” will be determined at Golden Maid’s sole discretion, in good faith, and using common sense and reasonable judgment.

Home Access

Client will give the Employee access to the inside of the house during regular business hours and any additional mutually agreed upon times. If Golden Maid agrees to enter the Client’s home to clean and we cannot gain access due to no fault of Golden Maid, Client will be charged 100% of the quoted cleaning rate. In the event the Client chooses to leave a door unlocked or place a key under a mat or any other unsecured place, the Client will not hold Golden Maid liable for any damages or theft to their home.

Rescheduling or Canceling Services

If the Client needs to cancel, reschedule, or skip a service, Client agrees to contact Golden Maid at least 48 hours before the service date to avoid any penalties. All cancellations must be made to Golden Maid via telephone call, text or email.

If the Client notifies Golden Maid of a cancellation on the same day of service, up to and including declining service at arrival, Golden Maid may charge the Client 100% of the quoted cleaning rate.

If the Client notifies Golden Maid of a cancellation the day before the service date, Golden Maid may charge the Client 50% of the quoted cleaning rate.

If a service is skipped, the next appointment may be billed at a higher rate depending on the amount of time that has passed and the extra work for the Employee. Clients will be notified before payment is processed.

Holidays

Golden Maid is closed on all major holidays. Any recurring services that fall on a holiday will be rescheduled or skipped for that week. During the event that one of your routine cleanings falls on a holiday, Golden Maid will attempt to reach the Client and reschedule service in good faith. Final approval with service times is at the sole discretion of Golden Maid.

Health & Safety

Every effort is made for the Employees to work safely. For this reason, we do not clean any bodily or pet waste/fluids, inside fireplaces, in outdoor areas such as patios, balconies or at heights above a 3-step ladder. If for any reason an Employee of Golden Maid feels that their personal safety is in danger due to actions by the Client, or the Client’s guests or animals, the Client will be notified and may be subject to cancellation fees outlined herein.

Pets

Golden Maid requests pets be contained in a pet carrier or a secure area of the home away from Golden Maid’s Employees. Employees also do not clean any pet waste or fluids, and may leave the job site if these are present in the home during service.

Cleaning Equipment and Supplies

Golden Maid will provide Employees with most cleaning solutions and equipment needed. To help prevent cross-contamination, the Client agrees to provide a vacuum, toilet brush, and any preferred cleaning products not provided by Golden Maid.

Payment & Tipping

Payment is due at the date of cleaning. Clients must provide a payment method before the service date via our secure web link or via phone with a Golden Maid Employee. Tips are not required, however, should a client desire to leave a tip for a Golden Maid Employee, they may do so by providing a direct payment to the Employee via cash or check payment in the Employee’s name.

In the event the Employee is not able to perform the full scope of services scheduled at their normal speed, Golden Maid reserves the right to charge for extra time spent in the Client’s home.

Failure to make prompt payment may result in your balance being sent to a collections agency. Late payments may incur interest at 2% per month.

Accidents or Damages

You agree that in the instance of damages, losses or claim arising out of or in connection with Services provided from the Company’s contractors, employees and/or independent contractors, you shall hold Golden Maid harmless and all liability associated with any such damage or claim shall be the sole responsibility of the Client. You expressly release Golden Maid from any and all liability resulting from any and all damage, loss, or other claim resulting from actions caused by or contributed to an employee and/or independent contractor of the Company during the course of Services provided by an employee and/or independent contractor of Golden Maid. In the event Golden Maid is aware of any damages that occur, Golden Maid shall notify the Client and determine next steps in good faith.

Golden Maid shall not be responsible for any damages or losses caused by the Client’s failure to provide accurate information, misuse of cleaning products, or any other factors beyond the control of Golden Maid, including, but not limited to, acts of nature, third-party interference, or the Client’s negligence. 

Non-Solicitation

Soliciting current or former employees undermines the good experience our clients have come to expect and our ability to maintain our staff. When a Client enters into an Agreement for services with Golden Maid, the Client agrees that they will not engage in a working relationship directly with any employee of Golden Maid during the course of this Agreement and up to a year from an employee’s separation from employment. Failure to do so will result in a $10,000 fee to the Client. Any attempt to solicit a current employee of Golden Maid Cleaning, LLC for private hire will result in a permanent termination of service. All employees are also required to sign an unfair solicitation agreement and will alert Golden Maid if they have solicited me for private work.

Notice and Consent to Electronic and Marketing Communications

For purposes of providing notice to you as required by contractual or applicable law or regulation, you hereby (i) consent to receive such notice from Golden Maid in electronic form, including, without limitation, by sending email to an email address linked to your user account with Golden Maid or by sending messages to a mobile phone number linked to your user account with Golden Maid, and (ii) agree that all terms and conditions, agreements, notices, disclosures and other communications that Golden Maid provides to you electronically satisfy any legal requirement that such communications would satisfy if they were in writing.

Further, you hereby agree that any notice provided to you by Golden Maid in such electronic form was provided with your consent and satisfied any such legal requirements as if such communication was in writing. You may opt-out of receiving text messages by replying “STOP” from the mobile device receiving the messages.

By using the Golden Maid Services, you hereby consent to receive, and authorize Golden Maid to contact you with, marketing and other non-emergency communications, including but not limited to autodialed, prerecorded or otherwise automated calls or text messages directed to your phone or mobile number as provided to Golden Maid. Further, you hereby agree that any such communications that have been sent to you by Golden Maid were sent to you with your consent. You agree and acknowledge that message frequency may vary and occur at unpredictable intervals, and that messaging and data rates may apply to such communications. You agree and acknowledge that you may revoke your consent to future such communications at any time by sending e-mail to [email protected].

Miscellaneous

Golden Maid may assign or delegate this Agreement, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under this Agreement without Golden Maid’s prior written consent, and any unauthorized assignment or delegation by you is ineffective. If any provision of this Agreement is held unenforceable, then the provision will be modified to reflect the parties’ intention, and all remaining provisions of this Agreement shall remain in full force and effect. You and Golden Maid are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement. Golden Maid reserves the right to modify or terminate the Services for any reason, without notice, at any time. This Agreement shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflicts of law rules. The failure of either party to exercise any right or provision of this Agreement shall not constitute a waiver of such right or provision. No wavier of Golden Maid’s rights under this Agreement shall be valid or effective except by a written agreement bearing the physical signature of an officer of Golden Maid. No purported waiver or modification of this Agreement by Golden Maid via telephonic or electronic communications shall be valid. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

If any provision of these Terms is held invalid, illegal or unenforceable, that provision will be enforced to the maximum extent permitted by law, given the fundamental intentions of the parties, and the remaining provisions of these Terms will remain in full force and effect.
